In what cases is a driver's license revoked?
Drivers know that the road is full of surprises. Various not always pleasant situations happen, for which you will subsequently have to be punished. In addition to the penalties imposed for violating traffic rules, there is currently a temporary deprivation of a driver’s license by the court.
In this article we will look at why a driver’s license can be revoked and for how long the ban will be in effect. The main conditions of this issue are described in the Code of Administrative Violations.
Purpose of non-financial punishment
Measures to combat traffic rule violators are being tightened. This is due to the desire of the state to instill a responsible attitude towards behavior on the road. This is due to the fact that transport accidents not only cause material damage, but also damage the health and lives of citizens.
Financial punishment is not an effective measure for everyone, which is why forms such as compulsory work and temporary deprivation of rights have recently been introduced. For many drivers, such factors have become decisive.
At the same time, the final decision on in what cases a driver’s license is revoked or a more lenient punishment is imposed, if possible, remains with the court.
There, the driver has the opportunity to defend his case in each situation.
Terms of temporary deprivation of a certificate
Certain time intervals for deprivation of rights are fixed by law. However, there are general restrictions for all cases. The regulations do not allow a period of less than 1 month for unlawful driving, and the maximum period is limited to 3 years. Options for revoking a vehicle's driving license for life are also being considered.
Interval 1-6 months
- You will be deprived of 1 to 3 months for driving without license plates in a registered car, as well as for not yielding to a special vehicle with color inscriptions and other markings on it and flashing lights on.
- From 2 to 4 months when transporting large cargo that protrudes 10 cm or more from the permitted norm.
- From 3 to 6 months during a closing or bypass of a closed barrier, as well as during other signals prohibiting the crossing of the roadway (semaphore, railway employee).
- You will be deprived of 4 to 6 months for exceeding the speed limit by 60-80 km/h. Violation of the transportation of large-sized cargo for special purposes (change of route, tonnage, footage). Drifting into the oncoming lane. Transportation of goods classified as “dangerous” without permits.

About liability for driving without documents, including for driving without a license after deprivation, read the article at the link.
If the deprived driver is under the influence of alcohol or drugs, liability will arise in accordance with Part 3 of Article 12.8 of the Code of Administrative Offenses of the Russian Federation.
In this case, the punishment is provided in the form of administrative arrest for a period of ten to fifteen days or the imposition of an administrative fine on persons against whom administrative arrest cannot be applied in the amount of thirty thousand rubles.

Why your driver's license can be revoked - DRIVE2
The more serious the violation of traffic rules, the harsher the punishment. Deprivation of the right to drive is applied for those sins that either lead to serious consequences or do not allow the state to control your actions on the road.
The period of deprivation may vary. In some cases, the legislator considered that a month of walking on foot was enough for the violator, but he could remain without a license for a long time. If the law provides for a range of punishment - for example, deprivation of rights for a period of one to three months - the specific period is set by the court.
From a month to three
The minimum period for confiscation of a driver's license is established for driving a car without license plates. If the numbers are installed in places not provided by the manufacturer, the violator will also be punished by deprivation of rights (Part 2 of Article 12.2 of the Code of Administrative Offenses of the Russian Federation).
The same punishment will follow in the case of repeated driving of a car that is not registered with the traffic police (part 1.1 of article 12.1).
If you do not give priority to a special vehicle with its light and sound signals on, you will lose your driver’s license for the same minimum period - from a month to three, depending on the court decision (Part 2 of Article 12.17)
Three to six months
Such punishment is provided for in Part 1 of Article 12.10 for one type of violation - incorrect passage of a railway crossing. This includes driving through a prohibiting traffic light (closed barrier) and crossing a railway outside specially designated areas. Stopping at a crossing is also punishable.
Four to six months
This group includes violations related to speeding by 60–80 km/h (Part 4, Article 12.9), driving into oncoming traffic, including tram tracks in the opposite direction (Part 4, Article 12.
15), and driving “against the grain” on a one-way street (Part 3 of Article 12.16).
In addition, you can lose your license for four to six months in case of repeated driving through a prohibiting traffic light signal (or instructions from a traffic controller) - in accordance with Part 3 of Article 12.12.
In addition, Part 5 of Article 12.23 establishes punishment in the form of deprivation of the right to drive for the same period for violating the rules for transporting groups of children. Special rules establish that children can only be transported during the day; at night (from 23:00 to six in the morning) you can move in exceptional cases - to complete the route, for example, to a train station, airport or hotel.
For half a year
Six months of deprivation of rights are provided for those who drive too fast - in case of exceeding the permissible speed by more than 80 km/h (Part 5 of Article 12.9).
From six months to a year
For such a period, a driver’s license will be deprived for driving a car with false registration plates (Part 4 of Article 12.2), as well as for driving a car with red light devices installed on the front part of it (Part 3 of Article 12.5).
For a year
You can be left without a license for 12 months for repeated violation of several rules at once. These are, for example, the rules for the passage of railway tracks (Part 3 of Article 12.10). They will be equally severely punished for repeated: driving into oncoming traffic or tram tracks (Part 5 of Article 12.15), driving against the flow on a one-way street (Part 3.1 of Article 12.16), speeding by 60–80 km/h or more (h 7 Article 12.9).
For debts to pay fines or alimony, bailiffs may suspend a driver's license. After repaying the debts, the rights become “working” again. But if you are caught driving while your license is suspended, the punishment will be severe—up to a year of license deprivation. The basis is Article 17.17 of the Code of Administrative Offenses of the Russian Federation.
From a year to a year and a half
If you are driving a car on which sound and light signaling devices are illegally installed (Part 4 of Article 12.5), or if the car is painted to look like a special services vehicle (Part 6 of Article 12.5), you will be deprived of your license for a period of one to one and a half years . The same period of imprisonment is provided for leaving the scene of an accident (Part 2 of Article 12.27).
The same punishment threatens if, through your fault, slight harm was caused to the health of another participant in the accident (Part 1 of Article 12.24).
From one and a half to two years
Section for the most serious, in the opinion of legislators, violations. These include the illegal use of special signals (part 5 of article 12.5), driving while intoxicated (part 1 of article 12.8), transfer of control to a person in a state of intoxication (part 2 of article 12.8), refusal of examination (part.
1 tbsp. 12.26), causing moderate harm to health (Part 2 of Article 12.24). This also includes drinking alcohol after an accident - until police officers conduct an examination or decide that such an examination is inappropriate (Part 3 of Article 12.27).
