Stopping prohibited: fine for stopping in the wrong place

What is the fine for parking in the wrong place?

Motorists do not always adhere to traffic rules and sometimes stop in the wrong place. There are many reasons for this, such as lack of parking nearby.

In any case, this is not an excuse and such an act is a violation, for which you face a fine for a “No Stopping” sign. In what cases is it prohibited, and what amount of fine awaits violators?

No stopping and parking signs

No stopping signs are of utmost importance. Every year the number of cars increases, and stopping in the wrong place can lead to traffic jams or completely block traffic. Therefore, it is important to adhere to the rules, otherwise you cannot avoid penalties for violation.

A “No Stopping” sign with an addition indicating the possible evacuation of the vehicle.

Some beginners confuse stop and parking signs; what is the difference between them and how to distinguish them? Both signs are slightly similar in appearance: a blue circle with a red border. A no-parking sign will have one red diagonal stripe, while a stop sign will have two stripes.

Judging by its appearance, the conclusion suggests itself: the “No Stopping” sign is more serious. It is prohibited to stand behind it, the exception applies only to public vehicles, but in specially designated areas.

Signage area

The ban begins at the point where the sign is installed. The car owner should also be aware of the coverage area of prohibitory signs.

The length varies, up to:

  • first intersection;
  • the end of the settlement;
  • a sign indicating the end of the zone of all restrictions.

In addition, information about the distance at which the restriction applies is often provided under the sign.

In more detail:

Additional exclusion zone signs.

  • the down arrow indicates the end of the ban immediately after passing the sign;
  • a sign with down and up arrows means driving through a restricted area, this is an additional warning: there was previously a restrictive sign and its effect has not yet ended;
  • an upward arrow with the footage indicated below it indicates the lifting of the ban after traveling this distance;
  • signs with arrows to the sides and meters are used to limit parking along squares and facades. Having traveled the distance specified in the information, the ban will cease.

Not all places that exclude the possibility of stopping or parking a vehicle have a corresponding sign.

Prohibited parking areas without the need to be marked with a sign.

Car owners are not allowed to stop in the following places:

A complete list of places prohibited for stopping and parking according to traffic regulations.

  1. Less than 5 meters before the zebra crossing or directly on it, immediately after the ban does not apply. This rule is extremely important; ignoring it can create a nuisance for people and even provoke an emergency.

  2. Tram rails or a close distance to them, such an action will make the passage of transport impossible and will lead to traffic delays and inconvenience for passengers.
  3. “Dedicated area” reserved for cyclists or public transport.

It is important to know that driving on this lane is also prohibited, for which penalties will apply.

  4. Crossroads and less than 5 meters to it.
  5. Areas where a car will block a road sign, traffic light or interfere with pedestrians.
  6. A narrow road where the distance between the vehicle and the “solid” road is less than 3 meters.

On a single-lane road, the distance from the car to the other edge should be no less.

  7. The roadway when there is a dangerous turn or hill nearby. Stopping or parking in such places can lead to serious accidents.
  8. A bus stop and a distance of less than 15 meters in front of it.

Passengers can disembark/embark here without creating any interference.

  9. Bridges, tunnels, railway crossings.
  10. Parking spaces intended for disabled people.

Fine for stopping in the wrong place

Let's look at the most popular:

The fine for illegal stopping, parking and other common traffic violations.

  1. If you break the rules without causing interference to other traffic participants, you can get off with only a warning or a minimum fine of 500 rubles.

  2. Parking in a space reserved for the disabled will cost 5,000 rubles.
  3. If you leave your car in a zebra crossing, at a public transport stop or on the sidewalk, you will have to pay 1,000 rubles.

  4. If traffic stops on tram tracks and in the middle of the roadway, or if you ignore the requirements of a “dedicated area” and a prohibitory sign, you will be subject to an administrative fine in the amount of 1,500 rubles.

  5. If you stop at a railway crossing, you can pay 1,000 rubles or lose your driver’s license for a period of 3 to six months. Repeated violation will result in a one-year license suspension.
  6. Stopping in the wrong place, causing a traffic jam, will entail an administrative penalty in the amount of 2,000 rubles.

The same amount “shines” if you stop in the tunnel.

In addition, the vehicle may be towed. Then the driver will have more trouble: he will have to look for where the car was taken, pay the costs associated with evacuation, as well as stay in the impound lot.

Drivers often encounter car damage caused during evacuation. This case will incur additional costs.

When can an exception be made?

Various things happen on the roads: unforeseen circumstances, poor health, breakdown and more.

In such situations, to avoid a fine for stopping at a sign, do the following:

  • turn on the emergency lights;
  • set up a triangle.

Controversial situations

Disputes sometimes arise between the driver and the traffic police inspector regarding violation of traffic rules and the presentation of a fine for stopping under a sign or in an unauthorized place.

Car owners are required to clearly distinguish between the concepts of “stop” and “parking”. As mentioned above, in the first case it is allowed to stand for no more than 5 minutes with the emergency lights on. Only when boarding/disembarking passengers or unloading cargo is it possible to stand a little longer. Everything else will be considered parking.

In such a situation, the car owner is punished for idle time in the wrong place. There are also misunderstandings online regarding the fine received for parking in residential areas. It is important to know that trucks weighing more than 3.5 tons are prohibited from parking in this area, as well as cars with a running engine.

Conclusion

Car owners often break the rules, especially when stopping a vehicle in the wrong place. Such prohibitions are ignored because it is not always possible to find a parking space, it is too far away, or other reasons contribute to this. Be that as it may, you can pay for this violation with a fine, the amount of which will depend on the situation.

What is the difference between the signs and in what places do they operate? Every driver must be able to distinguish between no-parking and no-stop signs, and also have information about the meaning of the signs located under the sign itself.

There are also unforeseen situations when you have to make an exception - then it is important to take care of the alarm and the “triangle”. It should be remembered that violation of these rules may entail not only administrative penalties, but also the creation of emergency situations.

Have you been punished for such violations?

What is the fine for parking in the wrong place?

04.04.2018

Separately, it is worth noting the fact that penalties for cities with federal status are significantly different. So, for example, stopping a car in such cities in the wrong place will cost the driver 1,500 rubles. And if the vehicle also interferes with the movement of other participants, the amount of the fine will increase to 3,000 rubles.

Fine for parking in the wrong place

  1. On and near tram rails, if the vehicle will create an obstacle to the movement of the tram. The first part of the ban, as a rule, is clear to everyone, since it is unlikely that motorists would think of parking their car directly on tram tracks.

The second one is more difficult - the following is unclear: is it impossible to park in close proximity to the rails in any situation, or only when an abandoned car will interfere with the tram? There are plenty of abandoned tracks that have been abandoned by rail vehicles for a long time, so why not stop next to them? However, it is better not to do this, since the tram can still go, and by an unfortunate coincidence there will be a traffic police inspector nearby, who will happily and absolutely legally fine you.

  2. At railway crossings, in tunnels, on bridges, overpasses, overpasses (and under them). There is one caveat here - stopping is allowed if the bridge (overpass or overpass) has three or more lanes intended for traffic in one direction. When there are only one or two lanes, stopping is prohibited, and therefore parking is also prohibited.
  3. Too close to a continuous road marking line. There must be at least three meters between a stopped car and a solid (or dividing strip) so that the parked car does not interfere with the movement of other vehicles. If the road is one-way, then three meters must be maintained from the opposite edge of the roadway to the car.
  4. Directly on the zebra crossing and closer than 5 meters before the pedestrian crossing. It is logical that a car stopped at a zebra crossing will create an obstacle for pedestrians when crossing the road. Why can't you park your car right before the crossing? In this case, you will block the view of the crossing for other drivers, who will not be able to see whether there are people crossing the road, which can easily lead to an accident. If you want to park on the left side of a two-lane road, you should go through the pedestrian crossing and stop driving 5 meters after it.
  5. In conditions of poor road visibility (the roadway is visible for less than 100 meters in any direction).
  6. Near dangerous bends in roads, on hilltops, etc.
  7. At the intersection of roadways, as well as at a distance of less than 5 meters to the edge of the crossed roadway. There is a controversial point here - it is logical that any intersection will be the intersection of roadways, but what about leaving the yard or a gas station? It is better not to park in such areas, as otherwise your car will interfere with other cars, for example, when turning.
  8. At public transport (or taxi) stops and within 15 meters of them in any direction. As a rule, drivers are informed about the presence of a stop by a corresponding sign or road marking, from which a fifteen-meter distance should be counted.
  9. On sections of the road where a car is parked:
    • will block traffic lights or road signs from other motorists;
    • will create an obstacle to the movement of other cars;
    • will interfere with pedestrians.
  10. In lanes reserved for cyclists.

Fine for parking or parking in the wrong place

The increasing number of cars in cities makes parking more and more difficult. There are always not enough free spaces, and you don’t want to spend money on paid ones, so drivers do not rule out the possibility of parking and stopping where the law does not allow it.

What is the fine for illegal parking?

Stopping a vehicle on the sidewalk is the most common violation among motorists, and some of them do not even suspect that they face a fine.

The driver, when making a stop, drives onto the curb so as not to interfere with the movement of other vehicles, but in fact he is committing a gross violation of traffic rules.

Driving onto the curb with even one wheel is regarded by the traffic police as a full violation of the rules.

What is the fine for illegal parking in different places?

  • Cars with active engine operation for more than 5 minutes unless loading/unloading cargo or boarding/disembarking passengers. Particular attention should be paid to this point for those who warm up their car for a long time.
  • Trucks weighing more than 3.5 tons, unless special spaces are available.
  • Cars on lawns and sidewalks, unless there are special signs.
  • Violation of these traffic rules in accordance with Article 12.28 of the Code of Administrative Offenses entails an administrative penalty of a fine.

What is the fine for parking in the wrong place?

Parking can sometimes be very difficult. The problem described is especially relevant for large cities. Drivers also do not want to enter paid parking lots, because their cost is quite high.

In order to avoid paying a fine for parking in the wrong place, some drivers have found, in their opinion, a way out of this situation. They leave the car in a paid parking lot and at the same time thoroughly cover up the license plates, making them impossible to read. The calculation is simple.

Drivers believe that if they cannot identify the license plate, they will not have to pay. However, such actions were quickly stopped.

An anti-terrorism law came into effect in Russia, which made it possible to immediately evacuate such vehicles, which may pose a real threat. The cost of delivering a car to a impound lot is more than 5 thousand rubles, which the owner of the vehicle will have to pay.

Due to the frequent occurrence of offenses of this kind, a separate offense has been introduced for parking in spaces for disabled people. This fine for parking in the wrong place ranges from 3 to 5 thousand rubles. Of course, it all depends on the specific situation. But in this case the car is not confiscated.

Parking in the wrong place: the amount of penalties

In this case, relying on Art. 12.19. Part III.I, employees of the State Traffic Inspectorate can issue a payment for 3 thousand rubles: “Parking or stopping a vehicle at a public transport stop closer than 15 meters from the corresponding road sign is regarded as an offense and entails an administrative penalty in the form of a fine.”

Is there a penalty for parking a car in the wrong place?

Obstructing the movement of public transport is a fairly serious violation. Its danger lies in the fact that a car thoughtlessly left at a stop can create inconvenience not for one, but for several hundred citizens, disrupting the service interval of a bus or trolleybus route.

Responsibility for parking in the wrong place

  • Take a photo of the place where an unfair fine, in your opinion, was issued for parking.
  • Make a complaint with a full explanation of the situation (in any form).
  • If the fine was issued 10 or more days ago, you need to draw up a petition (petition) to restore the appeal period.
  • Any physical evidence confirming innocence.

What is the fine for illegal parking?

The imposition of a fine for parking in the wrong place arises in accordance with the text of Article 12.16 of the Code of Administrative Offenses, which determines the measure of liability that arises when the rules of stopping vehicles for a long time are violated.

On average, the amount that will be payable is 1,500 rubles for ordinary regions and can reach 3,000 rubles, provided that the violation took place in a locality of Federal significance.

Such cities currently include Moscow and St. Petersburg.

So, let's look at the concept of parking. Currently, parking by law is any pre-planned placement of a car within the existing public road network.

The term parking includes both a stop (a short-term cessation of the movement of a vehicle for the purpose of unloading or loading goods and passengers) and parking (a cessation of the movement of a vehicle for a long time that does not involve loading or unloading things, or getting people on or off) .

  1. Parking in the courtyard of a residential building (in violation of the rules).
  2. Stop on the sidewalk.
  3. On the bike path.
  4. In any places that make it impossible for other cars to pass, if a car blocks a traffic light or sign, it interferes with the passage of people.
  5. On or near tram tracks.
  6. In tunnels, on bridges and overpasses.
  7. At a distance closer than five meters to an intersection or pedestrian crossing.
  8. Closer than fifteen meters to a public transport stop.
  9. At a distance of closer than 50 meters to the railway crossing.
  10. On highways, autobahns.
  11. In special parking lots (for the disabled, corporate) without legal grounds.
  12. In any other places that are not provided for by law, but which are marked with the appropriate sign.

Fine for illegal parking in 2018

Parking is a specially marked and, in some cases, equipped space that is intended for organized parking of vehicles. The parking lot may be adjacent to the sidewalk, roadway, curb, or bridge. Depending on the decision of the owner of the plot of land or road on which the parking lot is located, its use can be either paid or free.

Fines for illegal parking

In order not to run into a fine for illegal parking of a car in 2018, it is worth knowing the rules by which parking is generally carried out. So, parking is a specially designated place for parking a vehicle.

It can be placed on the road or be part of other road network objects. Parts of buildings and structures are sometimes used as parking spaces - in the case of underground parking.

Parking for vehicles can be paid or free, this is decided by the owner of the territory on which it is located.

Appealing a parking fine in Moscow

Many Moscow motorists have encountered situations where a parking fine was dubious and ambiguous. Sometimes a fine can be imposed on completely ridiculous grounds.

But few people know what to do in such cases and whether it is worth appealing. Given the Moscow traffic, unfounded accusations may constantly be made. And the fines for illegal parking in Moscow today are quite considerable.

For the average person, an appeal ends in a useless trip to the traffic police.

If you approach this process more preparedly, then getting a satisfactory result in appealing a parking fine in Moscow will not be difficult.

Attention! If you have any questions, you can chat for free with a lawyer at the bottom of the screen or call: +7 (499) 938-50-82 Moscow; +7 (812) 425-68-16 St. Petersburg; +7 (800) 350-14-96 Free call for all of Russia.

Normative base

One of those cases when parking is considered illegal is a violation of the rules of stopping and parking in accordance with the Decree of the Government of the Russian Federation N 1090, paragraph 12. The fine for violating them in Moscow ranges from 2.5 to 5 tons.

R. Article 20.25 of the Code of Administrative Offenses of the Russian Federation provides for arrest for up to 15 days for failure to pay a fine. It is worth noting that such punishment is provided only for evasion of payment, but not in cases where the driver had a good reason.

How to challenge a parking fine?

There are a number of conditions for appealing charges for illegal parking by a car owner in Moscow. This must be done as quickly as possible. You can challenge the fine within 10 days from the date of delivery of the decision.

To understand who issued the parking fine in Moscow, it is enough to check the first digits of the UNN number, which will be indicated in the document:

  • 188 – traffic police
  • 035604 or 782 – MADI
  • 0355 or 780 – AMPP (in this case, the 50% discount on the fine will not apply)

If the driver does not have time to appeal the violation within 10 days, he will have to write a petition to restore the deadline and this will take much longer.

If you are not satisfied with the decision to challenge a fine in Moscow by one of these services, you can go to court and achieve a result there.

In which courts can a decision be challenged?

  1. Before you start appealing a parking fine, you need to check whether the appeal period has passed. In accordance with Article 30.3 of the Administrative Code, it is 10 days.
  2. If the appeal period has expired, you need to write a petition to restore this period.

Please note that this petition can only be submitted if there is a valid reason for missing the allotted time.

  3. To proceed directly to the dispute, you next need to fill out a complaint form. It contains the applicant’s details and his explanations.

  4. It will not hurt to have evidence of your innocence: screenshots of SMS, payment transactions, checks, copies of the decision and payment receipt. They are attached to the complaint as attachments.
  5. After this, you can send the collected materials to the above authorities.

There is nothing difficult in filling out the complaint form:

  • In the header you must indicate personal information and contact information.
  • Below is the date, number of the order and who issued it.
  • Next, you need to describe the reason for appealing a parking fine in Moscow. Here you can write everything in detail and in your own words, the main thing is that the reasons are convincing.
  • The current date and signature are placed at the bottom.

In most cases, only the applicant and the judge who will make the decision are present in court . You can take witnesses with you, and also, according to the constitution, Article 48 Part 2, you have the right to a lawyer to protect your interests.

First, the judge will read out information about the decision and the appeal, and then give the floor to the applicant. You need to tell it in detail, in your own words. Give your arguments of innocence. It is very important that they do not differ from those indicated in the complaint form.

Often, differences in testimony make the judge suspicious. After you have been heard, the judge may ask a number of additional questions. You only need to answer the truth. Firstly, it will be easier for you, and secondly, providing false information in court is punishable.

Afterwards the judge will announce his decision. The entire process usually takes no more than 20 minutes.

In this case, the parking fine will need to be paid within 60 calendar days. Otherwise, additional penalties may be imposed:

  • Increasing the amount of the fine to double the amount.
  • Administrative arrest for up to 15 days.
  • Compulsory work for up to 50 hours.

It is worth noting that if the court found the punishment for parking legal, then it is better to stop the appeal, since this almost never leads to a positive result. It is advisable to pay the fine as quickly as possible. After all, for 20 days there is a 50% discount on it if it is issued by the traffic police or MADI. The discount does not apply to AMPP fines in Moscow.

What fines may there be for non-compliance with parking rules in Moscow:

How to challenge a parking fine in Moscow online?

Of course, the easiest way to appeal the ruling, which most Moscow motorists turn to, is via the Internet.

Today, any receipt can be appealed in this way in just a few minutes.

If the fine was issued by a traffic police inspector, this can be done on the service’s website a style=”color: #4d0099;” href=”http://www.gibdd.ru/”>gibdd.ru in the “Services – receiving requests” section.

In the “Purpose of sending the appeal” , you need to indicate the “complaint” item.

Next, you need to fill out a simple form with your personal information and how you would like to receive a response. In the text of the appeal, describe in detail the situation that occurred and the evidence of your innocence.

It is recommended to enter as complete information as possible; you can additionally use the usual complaint form. If the result is positive, you will receive a corresponding letter containing information about further actions and cancellation of the fine.

You may also be asked for some clarification if the information provided is not complete.

If the decision on the violation was submitted by the AMPP or MADI services, then you should appeal it on the Avtokod website (avtokod.mos.ru) in the section “New services - appeal a fine for unpaid parking.”

In this case, it will be even easier to challenge a parking fine in Moscow. The process is carried out step by step with the necessary instructions:

  1. First you need to enter the resolution number. The system will automatically determine which service it was issued by.
  2. Next, you need to select the reason why you consider this parking fine to be illegal or erroneous. It is worth noting that there is even a “forced stop” clause if, for example, the driver suddenly develops health problems.
  3. Next, the driver will be presented with a list of documents that must be attached to prove his innocence.
  4. You will also receive the answer online.

How to challenge a fine for parking in the wrong place?

First of all, you need to make sure that there are the above grounds for serving a decision on illegal parking in Moscow. If in doubt, you can familiarize yourself with the relevant GOSTs and traffic rules.

Sometimes a fine can be issued even for parking closer than 15 meters from the intersection, or lack of visibility 100 meters. But the driver has the right to appeal in any case. You can challenge a parking fine in Moscow online, by mail or during a personal visit to the traffic police.

You can also go directly to court and challenge the decision there. Once a complaint has been submitted, it must be reviewed by the appropriate official. Then, within 10 days, a decision on the appeal must be made.

If you go to court, the complaint will be considered within 2 months. The procedure for challenging a fine for parking on a lawn in Moscow is similar.

It is important to be more careful when filling out each document. For example, you should not write about vehicle problems as reasons for parking.

In this case, according to the traffic rules, the driver must put up an “emergency stop” sign and turn on the hazard warning lights.

The fact is that you may receive additional fines for neglecting these procedures. According to Article 12.27 Part 1 of the Administrative Code, the amount of such a fine is 1000 rubles.

What should I do if I pay for someone else's parking?

Quite often, situations arise when a driver mistakenly pays for parking that is not his own or makes a mistake when entering a number. Such mistakes, of course, lead to fines for unpaid parking.

No matter how strange it may sound, many departments refuse to appeal in such a situation. But this applies only to AMPP and MADI.

When going to court recently, in most cases, drivers receive satisfactory decisions.

If there are still controversial issues, you can also consult free of charge via chat with a lawyer at the bottom of the screen or call: +7 (499) 938-50-82 Moscow; +7 (812) 425-68-16 St. Petersburg; +7 (800) 350-14-96 Free call for all of Russia.

Most often, positive decisions are made by judges of the Basmanny, Khamovnichesky and Tverskoy courts, so it is best to file a complaint in case of someone else’s parking there.

How can a disabled person appeal a parking fine in Moscow?

Often, traffic police inspectors are skeptical about cars parked in spaces for disabled people and sometimes make mistakes when presenting a report. Only disabled people of groups 1 and 2 have the right to stay in specially designated places if they have the appropriate documents.

Also, a “disabled person” identification sign must be installed on the rear of the car. This rule also applies to drivers accompanying disabled people, which also often leads to erroneous fines.

To appeal an unfounded fine, you can also go to court, or to the traffic police, MADI or AMPP.

Start collecting the necessary papers for an appeal as soon as possible. After all, after the 10-day appeal period has expired, it is not always possible to submit a petition for its restoration. The fact is that the driver must have a good reason for this. These include:

  • Illness or hospitalization.
  • Lengthy delivery times for letters, mail malfunctions.

Fine for parking in the wrong place: amount and grounds for imposing an administrative penalty

What are the risks for a driver when parking in the wrong place? Will an administrative fine be imposed?

In modern cities it is often difficult for people and cars to get along. Therefore, it is not surprising that personal vehicles are parked in places that are not entirely suitable for this. These include sidewalks, green areas, and even tram tracks.

Is there liability for drivers for parking in the wrong place?

First of all, this is leaving the car in the wrong place. Moreover, the rules for determining where parking is prohibited depend not only on the region, but also on the time of day. For example, in many cities you can find signs indicating that parking is prohibited only at certain times of the day.

In addition, in addition to clear traffic regulations, today local authorities are authorized to establish rules for parking cars in certain places.

For example, in Moscow they are revised almost annually. This consists of changing both the parking tariff and the areas where you can park your car completely free of charge for a certain period of time.

However, it should still be recognized that the concept of parking in the wrong place is not yet fully regulated by law. In this regard, an experienced lawyer can defend the driver’s rights both in authorized government agencies and in court.

Sanctions for illegal parking

Currently, the amount of the fine for parking in the wrong place, if a special sign indicates that stopping is prohibited, is established in Article 12.16, Part 4 of the Code of Administrative Offenses of the Russian Federation. Its regulations provide for a fine of 1,000 rubles.

However, the amount of sanctions will increase sharply if, contrary to the sign, parking took place in the wrong place in a city of federal significance. Such settlements, in particular, include Moscow and St. Petersburg.

12.16 Part 5 comes into play . It provides for the imposition of a fine in the amount of 3 thousand rubles.

Naturally, for many, the amount of the fine can be significant. Therefore, it is recommended to contact a lawyer who can provide assistance to all motorists who are in trouble. After all, the matter may not be limited to imposing a fine.

Additional consequences for the driver

If the driver parked his car in the wrong place, then it is possible to place the car in an impound area.

For example, today a fine of 1,500 rubles and the evacuation of the car are possible. Accordingly, in federal cities a fine of 3,000 rubles will be applied and the car will be towed.

At the same time, the driver will also bear additional costs associated with the operation of the tow truck. When such a situation arises, it is advisable to call a lawyer to the scene. He will help resolve the conflict situation and leave the vehicle at the disposal of its owner.

If the matter is only limited to a fine, then the help of a lawyer will still not hurt. After all, as we have already noted, legislative acts and regional rules are so vague that they allow multiple interpretations. Therefore, protecting the interests of the driver by a specialist will help solve many problems.

For example, a lawyer will represent the interests of his client in court when the matter concerns challenging a fine for illegal parking. In addition, it is possible that the dispute will be supported by the traffic police. In short, the help of a lawyer will be extremely useful for many drivers.

Fine for stopping, parking under a sign (stop, parking prohibited), in Moscow and St. Petersburg (Article 12.10, 12.16 and 12.19 of the Code of Administrative Offenses of the Russian Federation)

Modern traffic, to say that it is difficult, is to say nothing! Of course, with such traffic it is very difficult to park the car in which the driver was driving before.

As a result, many are forced to “throw away” the car, not just according to the rules, but we just didn’t get in the way.
As a result, if the car is not parked in accordance with the Rules, the driver faces a fine for improper parking.

I must say that this is one of the most common fines in big cities, which means this issue is very important for motorists. It is this type of fine that we will talk about.

Which article of the Code of Administrative Offenses of the Russian Federation regulates the fine for illegal parking, stopping, parking?

Everything you wanted to know about illegal parking is summarized in Articles 12.10 of the Code of Administrative Offenses of the Russian Federation, Part 1 “Violation of traffic rules across railway tracks”, 12.16 (part 4 and 5) of the Code of Administrative Offenses of the Russian Federation “Failure to comply with the requirements prescribed by road signs or markings of the roadway ” and Article 12.19 of the Code of Administrative Offenses of the Russian Federation “Violation of the rules of stopping or parking vehicles.” In article 12.

10 of the Code of Administrative Offenses of the Russian Federation provides examples for stopping at railway crossings, in Article 12.16 of the Code of Administrative Offenses of the Russian Federation you can find criteria that must be met in accordance with the requirements of road signs, but Article 12.19 of the Code of Administrative Offenses of the Russian Federation already provides for special cases when stopping (parking) is not made where required, but not under the “No Stopping” sign.

Let's say at pedestrian crossings, tram tracks, public transport stops...

We will examine all the options in more detail below, for each specific case.

Fine for stopping (departure) on railway tracks (crossing) (12.10 Code of Administrative Offenses of the Russian Federation, part 1)

The most dangerous, and therefore allocated to a separate rank, is stopping and parking at railway crossings and tracks. In fact, the stop should be according to one of the scenarios below, depending on the situation.

Also, according to paragraphs 12.4 and 15.3 of the traffic rules, it is prohibited to stop at the crossing, as well as go to them, if the traffic jam does not allow you to travel further. If these requirements are not met, then Article 12.10 of the Code of Administrative Offenses of the Russian Federation (Part 1) will be applied to the driver. “Violation of traffic rules across railway tracks”...

Crossing a railway track outside a railway crossing, entering a railway crossing when the barrier is closed or closing, or when there is a prohibiting signal from a traffic light or the crossing officer on duty, as well as stopping or parking at a railway crossing - entails the imposition of an administrative fine in the amount of 1000 rubles or deprivation of the right to drive vehicles for period from 1 to 6 months.

If the offense is repeated within a year, the driver may be deprived of the right to drive a vehicle for 1 year. Everything is written about this in the same article 12.10 of the Code of Administrative Offenses of the Russian Federation, but part 3.

Repeated commission of an administrative offense provided for in Part 1 of this article will entail deprivation of the right to drive vehicles for a period of 1 year.

So, we can summarize that stopping or parking at a railway crossing can cost the driver a fine of 2 “minimum fines” (1000 rubles) or deprivation of rights for up to 1 year. Next, we will analyze the situation when a stop or parking is made under a prohibitory sign.

Fine for stopping (parking) under a prohibitory sign, with the exception of St. Petersburg and Moscow

First, we will analyze the cases for most cities in Russia, that is, for all cities except Moscow and St. Petersburg. Indeed, depending on the city, a different fine will be applied to the violator.

Since St. Petersburg and Moscow are considered cities of federal significance, the punishment here is special... but more on that a little later, but for now about the fine for stopping or parking for all cities of Russia, except Moscow and St. Petersburg.
If you live in a relative province, that is, not in Moscow or St. Petersburg, then Part 4, Article 12.16 of the Code of Administrative Offenses of the Russian Federation will be used.

Failure to comply with the requirements prescribed by road signs or road markings prohibiting the stopping or parking of vehicles, except for the case provided for in Part 5 of this article, shall entail the imposition of an administrative fine in the amount of 1,500 rubles.

That is, if a violation of stopping (parking) under the signs “Stopping is prohibited” or “Parking is prohibited” is recorded, a fine will be issued in the amount of 3 “minimum fines” - 1500 rubles .
However, as we have already said, if such an offense is committed in Moscow or St. Petersburg, the fine will be higher. More on this later.

So, as we have already said once again, for residents and guests of Moscow and St. Petersburg the fines will be special, or rather more significant. It is difficult to say what prompted different amounts of fines to be imposed on different cities in the same country, either the welfare of the people, or the desire to profit from them. This is not for us, and that’s not what we’re talking about.

Let's just say that in Moscow and St. Petersburg, for stopping under a prohibitory sign, the same article 12.16 of the Code of Administrative Offenses of the Russian Federation, but part 5, will apply.

The violation provided for in Part 4 of this article, committed in the federal city of Moscow or St. Petersburg, entails the imposition of an administrative fine in the amount of 3,000 rubles.

That is, in Moscow or St. Petersburg, a fine for stopping under a prohibitory sign will cost twice as much, 3,000 rubles .

So there is no need to be offended by our capital residents, saying that all the best is for them, and there is more demand from them!
Now that we have talked about the cases regulating stopping (parking) at a railway crossing and under the signs “Stopping is prohibited”, “Parking is prohibited”, we will also talk about other options when incorrect parking or stopping can cost the driver a fine.

Fine for parking in the wrong place in Russian cities (Moscow and St. Petersburg)

Let's look at specific cases for which a driver can be fined for illegal parking. One of the common cases is if you parked in the wrong place... but not under a prohibitory sign or at a railway crossing. Such incidents are listed in Part 1, Article 12.19 of the Code of Administrative Offenses of the Russian Federation for Russian cities:

Violation of the rules for stopping or parking vehicles, except for the cases provided for in Part 1 of Article 12.10 of this Code and Parts 2 - 6 of this Article, entails a warning or the imposition of an administrative fine in the amount of 500 rubles.

And in part 5 of article 12.19 of the Code of Administrative Offenses of the Russian Federation, for the cities of Moscow and St. Petersburg

The violation provided for in Part 1 of this article, committed in the federal city of Moscow or St. Petersburg, entails the imposition of an administrative fine in the amount of two 2,500 rubles.

Comment: In fact, this legislation has only a general resolution with exclusionary conditions. But the exceptions will be:

– stopping under a prohibitory sign;
– stopping at railway crossings.

We have already discussed these cases above. And:

- stopping in places provided for stopping people with disabilities; - stopping 5 meters or closer to a pedestrian crossing, with the exception of an emergency stop or stopping on the sidewalk; - stopping 15 meters or closer to a public transport stop, with the exception of disembarking or picking up passengers; - stopping on tram tracks or not in the first lane;

– a stop resulting in difficulty in the movement of the vehicle (creating an obstacle);

...in such situations the driver will be subject to a much more serious fine. We will briefly talk about them below.

Fine for parking (stopping, parking) in a parking lot (space) for disabled people

In this case, Part 2, Article 12.19 of the Code of Administrative Offenses of the Russian Federation will be applied to the driver.

Violation of the rules for stopping or parking vehicles in places designated for stopping or parking vehicles of disabled people - entails the imposition of an administrative fine on the driver in the amount of 3,000 to 5,000 rubles.

How often can such an offense be seen in the parking lot of shopping centers, but in most cases it goes unpunished. Although in fact, as you can see, the fine is quite high.

Fine for parking 5 meters in front of and on a pedestrian crossing, as well as on the sidewalk

This option is provided for in Article 12.19 of the Code of Administrative Offenses of the Russian Federation, Part 3...

Stopping or parking of vehicles at a pedestrian crossing and closer than 5 meters in front of it, with the exception of a forced stop and the case provided for in Part 6 of this article, or violation of the rules for stopping or parking vehicles on the sidewalk, with the exception of the case provided for in Part 6 of this article, – entails the imposition of an administrative fine in the amount of 1000 rubles.

It’s worth mentioning right away that for Moscow and St. Petersburg such a fine will be many times larger, namely 3,000 rubles.

Fine for parking in front of public transport stops closer than 15 meters

Stopping at the public transport stop itself and in front of it, if it is not for disembarking passengers, and also if it interferes with public transport, is prohibited. This can be found mentioned in clause 12.4 of the traffic rules.

Parking of a vehicle in front of a public transport stop is regulated by Part 3.1 of Article 12.19 of the Code of Administrative Offenses of the Russian Federation...

3.1. Stopping or parking of vehicles at stopping places for route vehicles or closer than 15 meters from stopping places for route vehicles, with the exception of stopping to pick up or disembark passengers, a forced stop and the cases provided for in parts 4 and 6 of this article, shall entail the imposition of an administrative fine in in the amount of one thousand rubles….

And here, cities of federal significance (Moscow and St. Petersburg) are no exception, since they provide for a more serious fine, namely 3,000 rubles. We talked about this violation in more detail in the article “Fine for stopping at a bus stop.”

In this case, Part 3.2 of Article 12.19 of the Code of Administrative Offenses of the Russian Federation is applicable...

3.2. Stopping or parking vehicles on tram tracks or stopping or parking vehicles further than the first row from the edge of the roadway, with the exception of a forced stop and the cases provided for in parts 4 and 6 of this article, shall entail the imposition of an administrative fine in the amount of 1,500 rubles.

For Moscow and St. Petersburg the fine will be 3,000 rubles

Fines for parking and obstruction

Creating a small local collapse will cost you a little more than simply stopping at a prohibitory sign, since this option is regulated by Part 4 of Article 12.19 of the Code of Administrative Offenses of the Russian Federation...

Violation of the rules for stopping or parking vehicles on the roadway, resulting in the creation of obstacles to the movement of other vehicles, as well as stopping or parking a vehicle in a tunnel, except for the case provided for in Part 6 of this article, shall entail the imposition of an administrative fine in the amount of two thousand rubles. .

As always, in this case, for Moscow and St. Petersburg the fine is higher and will amount to 3,000 rubles.

To sum up the fine for stopping under a sign “Stopping is prohibited”, “Parking is prohibited” and more..

The collected material in the article is quite significant and extensive, which means that it will be difficult for an ordinary driver, not a lawyer, to cover all the material in the article at once.

Here you will have to turn to your memory every time, leaf through and twist on the page all the material presented.

In order to somehow simplify this task for you, it is better to look at the summary table, in which you can find the offense and immediately determine the size of the fine for it.

Detention of a vehicle when stopping where it is prohibited

A vehicle may be detained in the following cases of violation of a stop:

– the vehicle was left under the “No Stopping” sign, with the information sign “Tow Truck Operating”; - in front of the pedestrian crossing less than 5 m;

– in parking spaces for disabled vehicles;

- in tunnels and when creating interference; - at public transport stops;

- on tram tracks.

That is, if the driver abandons the car in such places and does not return to find his vehicle, then it is quite possible that it is already parked in a special parking lot. Moreover, all this is based on legal grounds. All this is prescribed by the norms of Article 27.13 of the Code of Administrative Offenses of the Russian Federation “Detention of a Vehicle”.
