Just a few years ago, you could safely get behind the wheel of a scooter without having any documents with you. Mopeds and scooters were not even classified as a separate category and could be driven by almost any citizen.

However, since 2013, some changes have been made to the laws. Now, in order to drive a scooter or moped, you need to obtain a license of the appropriate category. But is it possible to ride a moped if you already have a car license? Next, we will understand all the intricacies of the law and give an answer to this question.

What are the categories?

Art. 25 Federal Law No. 196 “On Road Safety” (hereinafter referred to as the Law) regulates the list of categories of vehicles:

Legal basis

Before answering the question of whether you can ride a scooter with a Class B driver's license, you should understand some legislative subtleties.

So, based on clause 1.2. According to traffic regulations, a motorcycle is recognized as a vehicle that:

  • has two wheels;
  • with or without a side trailer;
  • engine – more than 50 cubic meters;
  • Max. the speed provided for by the technical characteristics of the vehicle is more than 50 km/h.

Here, in the traffic rules, there is a definition of what a moped is:

  • A vehicle with two or three wheels;
  • technically provided max. speed – no more than 50 km/h;
  • engine – no more than 50 cubic meters (in the case of a fuel-powered engine);
  • or a power of no more than 4 kW (in the case of an electric motor).

There is no definition of what a scooter is in the current legislation. It is believed that a scooter is the same as a moped; accordingly, all legal provisions regarding mopeds also apply to scooters.

Art. 25 of the Law states that to drive a moped or a light quadricycle (as well as a scooter), you need a class M license. This means that to ride a scooter on Russian roads, a motorist needs to undergo training at a driving school and obtain a license of the appropriate class.

However, Part 7 of Art. 25 of the Law provides for an exception. To drive a scooter, you do not need to specifically study for class M - you can have a license of any other category. And it will be completely legal.

In other words, if the driver already has a driving license with category A, B, C, D or any other, he can safely get behind the wheel of a moped or scooter without fear of being fined. There is no need to study specifically for category M if you have any other category.

Up to 50 cubic meters

By virtue of the provisions of clause 1.2. Traffic regulations, if the engine is not more than 50 cubic meters, the vehicle is recognized as a moped (if there are other characteristic features, such as a maximum speed of no more than 50 km/h, the presence of two or three wheels, etc.).

Accordingly, in order to drive a vehicle with such an engine size, it is necessary:

  • obtain rights of class M (in the absence of rights of any other class);
  • or you can completely calmly get behind the wheel of a scooter, having in your hands a certificate of any other category (A, B, C, D, etc.).

150 cubes

Based on the norms of clause 1.2. Traffic rules if the engine is over 50 cc. see, and if other characteristic features are present, the vehicle is recognized as a motorcycle, and not a scooter or moped.

To avoid a fine for not having a license, you must obtain a special rank that allows you to drive a motorcycle - A. This is specified in Part 1 of Art. 25 of the Law.

It also says here that if the motorcycle engine capacity is not more than 125 cc. cm, and the maximum motor power does not exceed 11 kW, you can get a subclass A1 power unit.

Are there any fines?

Yes, fines for driving a scooter without a license are provided for by current legislation. The penalties are identical to those that apply to drivers who do not have or have forgotten a Class B license when driving a passenger car.

The Code does not separate liability for drivers of scooters, mopeds, motorcycles, cars or trucks - the punishment will be the same for everyone.

Part 1 art. 12.7. The Code defines the punishment for those who ride a scooter without having a class M or B license - a monetary penalty in the amount of 5 to 15 thousand.

If you have rights, but they were simply left at home, liability will follow under another article - Part 2 of Art. 12.3. Code. The fine for leaving your license at home is 500 rubles.

A traffic police officer may also issue a warning if he believes that the driver deserves leniency.

Nuances

So, let's draw some conclusions and consider special cases:

  • riding a scooter with a valid Class B license is allowed - however, the vehicle must comply with legal requirements and be a scooter or moped (and not a motorcycle);
  • You can drive a scooter both with class B and with a special category M;
  • if the engine capacity exceeds 50 cubic meters, the vehicle is recognized as a motorcycle; accordingly, licenses of category M, B and others (except A) are not suitable;
  • if the engine capacity is more than 50, but less than 125 cubic meters, the driver does not have to pass a class A license - it is enough to obtain subcategory A1;
  • if the driver rides a scooter without having a license at all, or having a license of the wrong class required in a particular case, he will be held liable in accordance with the current administrative legislation - that is, a fine of 5 to 15 thousand rubles;
  • if you have a driver's license, but it is forgotten at home, the punishment will be less severe - a 500 ruble fine or even a warning.

Is a tractor driver's license suitable?

Based on Part 7 of Art. 25 of the Law, to ride a scooter you must have a Russian national driving license of any open category.

A tractor driver's license will not be suitable, and the driver will face appropriate punishment for driving without a license.

Is it possible to ride a scooter with an international driver's license?

Part 7 art. 25 of the Law indicates the possibility of driving scooters with a driver’s license of any class, but specifically a Russian national driving license. The corresponding provision does not apply to international VU.

Foreign licenses for riding a scooter can only be used if the corresponding special category is open – M.

From what age

Based on Part 2 of Art. 26 of the Law, citizens who have reached the age of 16 years can obtain rights of one category and one subcategory:

  • M, which gives the right to drive scooters, mopeds and light quadricycles;
  • A1, which gives the right to ride motorcycles with an engine from 50 to 125 cc.

Thus, already at the age of 16 you can safely get behind the wheel of a scooter without fear of fines and other liability. Moreover, it is more expedient to obtain a class A1 license - you will be able to drive both a scooter and a motorcycle with an engine of no more than 125 cubic meters. If you get a special class M license, you will not be able to ride motorcycles.

What to do to avoid getting a fine

To avoid fines, the driver of a moped or scooter must follow some rules:

  • ride only on the right edge of the roadway or on a path intended for cyclists;
  • hold the steering wheel with only two hands;
  • do not transport heavy and dangerous goods;
  • move only with the headlight on, both during the day and at night;
  • do not cross the road at a pedestrian crossing (to do this you must dismount);
  • It is possible to transport passengers on a scooter only if the design features of the vehicle provide for this.

So, since 2013 in Russia you cannot “just pick up and get behind the wheel” of a moped or scooter. You need to study for a license at a driving school and get category M.

If you already have a license, you can safely drive a scooter, because the law allows you to ride a moped if you have any other category - A, B, C or D.
