First, like civilized people, the inspector and the driver get to know each other. The cornerstone in the relationship between traffic police inspectors and drivers is passing a medical examination for intoxication. You can't refuse! Otherwise, the responsibility is the same as for being in a state of intoxication - deprivation of rights for a period of 1.5 to 2 years.

There are loopholes for arbitrariness here. For example, an inspector stopped a colleague when he was taking his wife to the maternity hospital. Having assessed the situation, the future father was given a price: 2 thousand rubles - and you can continue to go “to the stork” or you will have to spend the next three hours undergoing an examination, and let the lady call an ambulance or go to the maternity hospital by tram. The second popular way of taking money is to ambush “alcoholics” at night at the entrances to airports. The driver is in a hurry to get to the flight, and it is easier for him to give the money than to be late.

You can fight this. And it is necessary! If you are taking a passenger to the hospital, you can refuse the examination, citing the fact that you are acting “in a state of emergency” (Article 2.7 of the Code of Administrative Offenses of the Russian Federation).

But in this case, the case will still go to court, to which it will be necessary to bring a certificate from the emergency room confirming the “extreme necessity.” You will probably be acquitted. Explain all this calmly to the money-hungry traffic police officer.

There is a high chance that he will decide not to contact you.

Another option (if you are sober!): Clearly and calmly explain to the employee that:

  1. you are absolutely sober, and the examination will confirm this;
  2. don't give a bribe;
  3. if the inspector colludes with the medical expert, you will undergo an independent examination. With the medical opinion, you will go to court and seek compensation for moral damages, costs of examination and lost profits (if, for example, you were going on a business trip and were late for your flight because of an inspector).

If possible, record the conversation on a voice recorder, warning the inspector about it.

The chances that a bribe-taker will contact someone “too smart”, from whom they still won’t get money, but will be dragged through the courts, are small.

By the way, from July 1, traffic police officers will again be able to conduct on-site initial examinations for intoxication. The “tubes” will return (now only in the form of certified devices), into which you can breathe right on the road.

And only if the driver does not agree with the results or refuses to “breathe”, he will be taken to a narcologist. There is a legal conflict: according to the law, the only document that a driver can demand from an inspector is his service ID. You cannot ask him about his certificate for the “pipe.”

Another “black hole” into which the money of legally illiterate drivers goes is window tinting. Many fall for the statement: “Your tint is too high, now we’ll take it for inspection, they’ll record everything, take off the license plates and send your car to a special parking lot.” There is, of course, a punishment for this offense, but it is not fatal - a warning or a fine of 100 rubles (Part 1 of Article 12.5 of the Code of Administrative Offenses of the Russian Federation).

Well, if it is heavily tinted, you cannot pass inspection. Tinting is measured only at stationary posts with the participation of state technical inspection inspectors.

Sometimes the inspector suggests dispersing on the spot. At the same time, there is no hint of a bribe in his honest eyes. The violator is shown some receipts, which are filled out immediately. The actual amount of the fine is included there. But the “caring” inspector promises to pay this receipt himself, so that the driver does not have to wait in line at Sberbank.

But the inspector doesn’t care, he has a stack of such receipts. For authenticity, a hefty pile of completed forms may actually be waved in front of the violator’s nose. Many happily agree. But in vain! These receipts are fake, printed on a photocopier. And the traffic cop will not go to any Sberbank: the fine will end up in his pocket.

It is easy to recognize such “caring” people: they only give the driver a copy of the false receipt, and “forget” about the receipt or resolution in the case of an administrative offense. According to the rules, these “forgotten” documents must contain bank details, according to which the fine is paid.

This is done exclusively in a bank, and not on the track.

PRINT AND SAVE

The list of documents that the driver must have with him and submit for verification to traffic police inspectors is written in the traffic rules:

  • driver's license (or temporary permit);
  • vehicle registration certificate;
  • inspection certificate;
  • power of attorney (when driving a car in the absence of the owner);
  • OSAGO policy.

Traffic police officers have no right to demand any more documents. In addition to the passport, the traffic cop is the same employee of the Ministry of Internal Affairs, like any policeman, and therefore can ask to see it.

Paragraph 208.

When addressing citizens and road users, a PM employee must say hello, placing his hand on his headdress, state his position, rank and surname, and then briefly state the reason and purpose of the appeal.

In the event of a citizen’s request, the employee, having fulfilled the same requirements, within the limits of his competence, takes measures to provide assistance or explains where to go to resolve the issue.

Clause 209. When stopping citizens, a vehicle or other road user, the PM officer must inform the citizen, the driver of the stopped vehicle, another road user detained for a traffic violation or other offense, his position, special rank and surname, as well as the reason for the stop. and/or detention.

Let's say an inspector stopped you and did everything as listed above from Appendix 1 to Order No. 370 of the Ministry of Internal Affairs of the Kyrgyz Republic. If when asked about the reason for the stop, he answers: document check! You can calmly answer that document verification is carried out only at stationary posts.

If the inspector insists on submitting documents and reminds you of paragraph 2.1.

1, according to which the driver is obliged to transfer the entire list of necessary documents to the inspector for verification, again remind him of the possibility of transferring documents for verification only at stationary posts.

If the inspector continues to insist, inform him that you will hand over the documents only for drawing up a protocol on the administrative violation.

Perhaps, after these arguments, he will inform you that a raid is being carried out and you are obliged to present documents to him as part of this event. In this case, find out the name from him and ask if there are documents indicating that the mentioned events were carried out.

If you are presented with these documents, find out how you can relate to this. For example, if a raid is being carried out to identify tinted cars, and your car is not tinted, by what right do they stop you and refer you to the raid?

If the inspector does not have any documents, call the duty station to find out the inspector’s phone number and ask the duty officer whether raid activities are really being carried out. If so, what is the name of the raid and what is it aimed at. Do not tell the duty officer the name of the raid mentioned by the inspector in advance.

In cases where an inspector, after stopping your vehicle, reports a violation of one of the traffic rules and demands to hand over documents, ask if he is going to draw up a report on an administrative offense against you.

If yes, then ask him about the possibility of familiarizing himself with any evidence regarding the alleged violation, which will be included as case materials. These could be radar readings (photos, videos), the presence of witnesses, and so on.

If there are any, ask to be introduced to them.

And even if you are refused to provide any evidence or there is no evidence at all, hand over the documents to the inspector to draw up a protocol.

The presence of case materials that will indicate a possible offense on your part is, first of all, important for the inspector himself.

After all, if you appeal the protocol, then the inspector will have to prove guilt, since the presumption of innocence will apply to you. This means that if the inspector does not have any case materials, then the protocol can be easily appealed. Report this to the inspector.

For example, if you are accused of exceeding the speed limit, citing radar readings, but there is no photo or video recording, what kind of protocol can we talk about? Of course, you are obliged to hand over documents for drawing up a protocol, but what's the point? This usually happens when the inspector pursues not entirely legal goals. Having realized that you will appeal the protocol, he will most likely return the documents to you.

It is also important to note that after stopping, the exact inspector who stopped your vehicle should approach you. In the case of drawing up a protocol, the same is true. And if other police officers join in the dialogue with the inspector, ask them to introduce themselves and show their official identification.

It happens that police officers demand to open the trunk and call it an inspection, misleading you, because an inspection is only a visual inspection of the car from the outside. During inspection, they don’t even lower the window, not to mention the trunk.

But the inspection of the vehicle gives the right to demand to open the luggage compartment or the car itself. Also, when inspecting a vehicle, an inspection protocol is drawn up, witnesses are invited (with identification documents), whose personal data is entered into the protocol.

The law clearly states that citizens must obey the lawful demands of police officers. You are not required to comply with illegal demands.

I consider it mandatory to record dialogue with police officers on video. The camera is a witness who cannot be bribed, intimidated or deceived.

To summarize, I want to emphasize that this article is not a way to evade responsibility or somehow interfere with the work of police officers.

PS If you become aware that some crime or terrorist act has occurred and, in connection with this, police officers stopped you, demanding that you open the luggage compartment and present documents for verification, treat this with understanding.

One of my friends, when he drives without a seat belt, does this so that the traffic cop doesn’t take him by surprise. But everything is fine with us and we are waiting for the inspector to approach the car. He introduces himself, looks at the insurance, driver's license, registration certificate and that's it - good luck.

The most important thing when communicating with people is not to be rude and behave correctly. When a traffic police officer stops a car, he must introduce himself and state the reason for the stop. On your part, you can ask him to show his official ID. I would recommend doing this only if you have not seen the badge of the traffic police inspector, which indicates his number or is an obvious scam.

The traffic police inspector may ask you to get out of the car; you should not resist this either, unless of course you want to start a conflict. However, you are not obligated to leave. The inspector can only offer you to get out of the car; he does not have the right to demand this, but it appears when the inspector writes:

  • Protocol on your detention in accordance with Article 27.4.1 of the Code of Administrative Offences;
  • Protocol on your removal from driving a vehicle in accordance with Art. 27.12 Code of Administrative Offences;
  • Protocol for the inspection of your car in accordance with Article 27.9 of the Administrative Code.

You must hand over the documents for the car and driver's license to the inspector.

After checking the documents, if everything is in order, they will wish you a safe journey and move on.
